This policy applies to consumers who purchase products from Biatec Watches through our online store. It explains your right to withdraw from a distance contract, how to return a product and how refunds are processed.
If you are a consumer and purchased a product through our online store, you have the right to withdraw from the purchase contract without giving any reason within 14 days. For the purchase of goods, the withdrawal period expires 14 days from the day on which you, or a third party designated by you other than the carrier, acquire physical possession of the goods.If several products ordered in one order are delivered separately, the withdrawal period begins on the day you acquire physical possession of the last product delivered.If a product consists of several parts or pieces delivered separately, the period begins on the day you acquire physical possession of the last part or piece.You may also withdraw from the contract before the goods are delivered to you.
To exercise your right of withdrawal, you must inform us of your decision to withdraw from the contract by an unequivocal statement.You may do so:

You may also use our Model Withdrawal Form (PDF) available on this page, but its use is not mandatory. To meet the withdrawal deadline, it is sufficient to send your notice of withdrawal before the relevant withdrawal period expires.
You may exercise your right of withdrawal electronically by using the Withdrawal from Contract Form available below on this page. Complete the required information and select “Confirm Withdrawal from Contract” to submit your notice.After submitting the online withdrawal, you will receive confirmation of receipt electronically. Using the online form does not affect your right to withdraw from the contract by another method permitted by applicable law.
After withdrawing from the contract, you must send or hand the product back to us without undue delay and no later than 14 days from the date on which you informed us of your withdrawal. Please return the product to:

The return deadline is met if you send the product before the 14-day return period expires. Unless otherwise agreed or required by applicable law, the direct cost of returning the product is borne by the consumer. We recommend packing the product securely and using a tracked and appropriately insured shipping method, particularly when returning a watch. Please do not send products to us cash on delivery unless this has been agreed with us in advance.
You may inspect and handle the product only to the extent necessary to establish its nature, characteristics and functioning, in the same way as you would reasonably be able to do in a physical store. You are liable only for any diminished value of the product resulting from handling beyond what is necessary to establish its nature, characteristics and functioning. Opening the packaging or reasonably inspecting or trying the product does not in itself remove your right to withdraw from the contract. We recommend returning the product, where possible, with its original packaging, documentation and accessories. The absence of original packaging does not in itself remove your statutory right of withdrawal, but you remain responsible for any reduction in value for which you are liable under applicable law.
If you validly withdraw from the contract, we will refund all payments received from you in connection with the contract, including the cost of the original delivery to the extent required by applicable law. If you selected a delivery method more expensive than the least expensive standard delivery method offered by us, we are not required to refund the additional cost resulting from your choice of the more expensive delivery method. We will make the refund without undue delay and no later than 14 days from the date on which we are informed of your decision to withdraw from the contract. We may withhold the refund until we have received the returned product or until you provide evidence that you have sent the product back, whichever occurs first. Unless expressly agreed otherwise, the refund will be made using the same means of payment that you used for the original transaction. You will not incur any fees from us as a result of the refund.
The right of withdrawal does not apply in cases excluded by applicable law. In relation to products sold by Biatec Watches, this may apply in particular to goods made according to the consumer's specifications or clearly personalised goods, provided that the statutory conditions for the exception are met. This may include, for example, a watch or other product individually personalised at the customer's request by custom engraving or another permanent individual modification. Selecting a standard model, colour, strap, bracelet or another normally offered product option does not necessarily mean that the product is made to the consumer's specifications. Where a product is subject to an exception from the statutory right of withdrawal, the customer will be informed where required by applicable law.
The statutory right to withdraw from a distance contract without giving a reason is separate from your rights relating to defective goods. If your Biatec product is defective, you may have rights under the statutory liability for defects and, where applicable, under the 5-Year Biatec International Warranty. You do not need to use the 14-day withdrawal procedure in order to exercise your rights relating to a defective product.
